This was just sent out an hour ago, from an attorney that responded to Rob D'Amico's call for aid. Short story, Richard Polendo IS GETTING OUT:

Just to let you know, I went to the jail and met with Richard Polendo. He has been there for three full days. I talked to the judge and he agreed to release Richard on a personal bond, with my assurance that he would appear in court. He was charged with a Class B misdemeanor which carries the same penalty as DWI (up to 6 months in jail). If anyone was a witness to the arrest, I would like to talk to them. The police say that Richard "fell" from his bike, but it sounds more like he was knocked off of his bike. They also referred to CM as an "anarchist bike group." BIG THANKS go out to Mr. Warren, Rob D'Amico, and whomever the judge was that saw fit to release Mr. Polendo. I'm so glad this part of the overall issue has been resolved. Now to work that little cops pushing us off our bikes before arresting us thing.

Mr. Warren's really stuck his neck out for the cycling community, doing this all pro bono. We owe it to him to help him back, so if ANYONE saw the officer pushing Richard, the arrest, or have any other information that may relate to this case, please drop them a note. I've dealt with at Class B Misdemeanor in my past (I haven't always been the mild mannered cyclist you know today), and let me tell you it was a big pain in the ass. Anything to help Richards case would be much appreciated.

Seriously though Rob, as of now you're permanently in my good book. Next few beers are on me.

i'm assuming he's somewhat of a free man.... i hope he got his bike back in good condition... what a awesome community we have here to make this happen! I contacted daily texan, statesman, and fox 7 news with the original like to story here on atxbs.com ... they all responded that they were at least passing the info on to their editors... hopefully we can get some follow up and attention on this issue... what a way to scare of new comers and visitors...

So glad to hear he's out of their system, and thanks for getting the word out to the local news, though if I may request it PLEASE contact other stations beyond Fox. I'd like a REAL news channel to cover the issue and look at it a little more objectively.

technically i think he's still in, but in process of being released... website has reflected his PR bond status.
